Our company registration number is 10365706, and our VAT number is 473062304. By placing an order through this Website, you agree to the following Terms and Conditions of Sale. Please read them carefully before making a purchase.
1. General Information
1.1 These Terms and Conditions govern the sale of products (“Products”) by Sarah-Jayne Creative Ltd trading as Tropical Punch (“we,” “us,” “our”) to customers (“you,” “your”) through our Website, www.tropicalpunch.co.uk.
1.2 Our Website offers original art, wall posters, homeware, clothing, and gifts for online purchase.
1.3 These Terms and Conditions do not affect your statutory rights under the Consumer Rights Act 2015.
1.4 By purchasing from our Website, you confirm that you are at least 18 years old or have the consent of a parent or guardian, and that you agree to abide by these Terms and Conditions.
2. Orders and Acceptance
2.1 All orders placed through our Website are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or descriptions, or suspected fraudulent activity.
2.2 Once your order is placed, you will receive an order confirmation email. This email is not an acceptance of your order but acknowledgment that we have received it. The contract of sale is formed when we dispatch the product(s) to you.
3. Pricing and Payment
3.1 All prices are displayed in GBP (£) and include VAT where applicable. Prices are subject to change without notice.
3.2 Any additional charges, such as delivery fees, will be clearly displayed at checkout before payment is completed.
3.3 We make every effort to ensure accurate pricing but reserve the right to correct errors. If an error in pricing or description is found after your order is placed, we will contact you to confirm whether you wish to proceed with the corrected price or cancel your order.
3.4 Payment is required in full at the time of purchase. We accept the following payment methods: (credit/debit cards, PayPal, apple pay etc)
4. Shipping and Delivery
4.1 We ship globally. Shipping options and delivery times may differ depending on the product and destination. Some Products may not be available for international shipping.
4.2 We aim to process and dispatch orders promptly. Delivery times are estimates and may vary due to circumstances beyond our control, including customs clearance delays.
4.3 Risk of loss and title for the Products pass to you upon delivery.
4.4 Customers are responsible for any applicable customs duties, taxes, or import fees for international orders.
5. Returns and refunds – excludes original art pieces, see section 7
5.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving the Products.
5.2 To exercise your right to cancel, you must notify us in writing via email at [sarah@sarahj-creative.com] within the 14-day period.
5.3 If you cancel your order, you must return the Products to us in their original condition within 14 days of notifying us. Return shipping costs are your responsibility unless the Products are faulty or not as described.
5.4 Refunds will be issued within 14 days of receiving the returned Products or proof of return.
6. Faulty or Misdescribed Goods – excludes original art pieces, see section 7
6.1 If a Product is faulty, damaged, or not as described, you are entitled to a full refund, repair, or replacement in line with the Consumer Rights Act 2015.
6.2 You must notify us of any faulty or misdescribed Products within 14 days of receipt by contacting [sarah@sarahj-creative.com].
6.3 Beyond 14 days, we will offer a repair or replacement. If a repair or replacement is not possible, you may request a partial or full refund. Each case will be carefully and fairly considered.
7. Original Art pieces
7. 1 Authenticity - Each original art piece is an original creation by a Tropical Punch creator. A certificate of authenticity signed by the artist will accompany the piece. The description of the artwork, including its dimensions, medium, and other details, is accurate to the best of our knowledge.
7.2 Ownership and Copyright - Ownership of the artwork transfers to the buyer upon receipt of full payment. This sale does not include copyright, reproduction rights, or any other intellectual property rights, which remain with the artist. The artwork is for personal use only and may not be reproduced or commercially exploited without express written permission from the artist or Sarah-Jayne Creative Ltd.
7.3 Delivery - The art piece will be shipped using a tracked and insured courier service. Shipping costs and delivery times will be calculated and communicated at checkout. Please inspect the artwork upon delivery. Any damages must be reported to us within 48 hours of receipt.
7.4 – Returns - Original artworks are non-returnable unless they are found to be damaged or not as described. Bespoke or commissioned artworks are exempt from cancellation under the Consumer Contracts Regulations 2013.
8. Intellectual Property
8.1 All content on our Website, including but not limited to text, images, logos, and product descriptions, is the property of Sarah-Jayne Creative Ltd and is protected by copyright and trademark laws.
8.2 You may not reproduce, distribute, or use any content from our Website without our express written permission.
9. Limitation of Liability
9.1 To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of our Website or purchase of Products.
9.2 Our total liability in connection with any claim is limited to the amount paid for the Product(s) in question.
